There are no legal restrictions on taking pictures in a public location with no presumption of privacy for folks in a public location

The particular laws regarding Home Cctv is very different form the legislation regarding Cctv in business oriented premises or those utilised by public bodies (police forces, local councils etc).





It would appear that almost every day we run into articles claiming 'Human Rights Act this' or 'Data Protection' that - the simple truth is, when you really start to check out who the data Protection and Human Rights Acts apply to, you'll realise that you have a lot more legal rights regarding Home Cctv than you might think.





The human Rights Act pertains to Public Bodies Only, not property owners or private individuals.

Q. My neighbour has mounted a Closed-circuit television video camera which is directed towards my house / garden. Is this a violation of the Data Protection Act?





A. If your neighbour's camera is installed on their own home property and used for their own individual domestic use, they are unlikely to be breaching the Data Protection Act. This is really because the application of Closed-circuit television surveillance cameras for domestic security purposes is exempt from the data protection principles. This applies when an individual uses Cctv to protect their home from theft, even if the camera overlooks the road or other areas near their house .
